1. Scope
1.1 These Terms & Conditions apply to all purchases made via jyotima.com and the related checkout and members area pages operated by:

1.2 By placing an order, you accept these Terms. Any conflicting terms of the customer do not apply.
1.3 Our offers are primarily intended for entrepreneurs, self-employed professionals, freelancers and business founders (“business customers”). Where a purchase is made by a consumer, the mandatory consumer protection rules of the consumer’s country of residence remain unaffected.
2. Contract Formation
2.1 The products presented on our website are not a binding offer, but an invitation to place an order.
2.2 By completing the checkout, you make a binding offer to purchase. The contract is concluded when you receive the order confirmation by email.
2.3 You agree to provide accurate and complete information when ordering.
2.4 Payments are processed via ThriveCart. Some products are sold via Digistore24, which acts as the reseller; in that case, Digistore24’s terms apply to the purchase (see section 5.4).
3. Prices and Payment
3.1 The price shown at the time of your order applies. All prices are stated in the currency shown at checkout. Applicable taxes are calculated and displayed at checkout.
3.2 Payment is due immediately upon ordering, using the payment methods offered at checkout.
4. Delivery of Digital Products
4.1 All products are delivered digitally. After payment, you will receive access to your product by email and/or via your personal members area.
4.2 Access is usually provided immediately after successful payment. If you do not receive your access within 24 hours, please check your spam folder and contact info@jyotimaflak.com.
5. Right of Withdrawal and Refunds
5.1 Business customers: There is no right of withdrawal or return for business customers. All orders are binding once completed.
5.2 Consumers in the EU: Consumers generally have a 14-day right of withdrawal. However, for digital content that is not supplied on a physical medium, the right of withdrawal expires once delivery has begun, provided that you have expressly agreed at checkout that delivery begins before the end of the withdrawal period and have acknowledged that you thereby lose your right of withdrawal.
5.3 Apart from the above, no refunds are provided for digital products, online courses, downloads, coaching or consulting programs purchased via ThriveCart once access has been granted.
5.4 Purchases via Digistore24: For products purchased via Digistore24, Digistore24 acts as the reseller. The withdrawal and refund terms of Digistore24 apply to these purchases, including any money-back guarantee stated on the respective product page.
6. Usage Rights and Copyright
6.1 All content, including ebooks, templates, worksheets, videos, audio files and AI prompts, is protected by copyright and remains the property of Jyotima Flak.
6.2 With your purchase, you receive a personal, non-transferable right to use the content for your own business.
6.3 You may adapt templates for your own products and marketing. You may not resell, share, publish or distribute the original materials, in whole or in part, or make them available to third parties, unless expressly permitted in writing.
6.4 Access to the members area is personal. Sharing login details is not permitted.
7. No Guarantee of Results
All content is provided for educational and informational purposes. Any results described are examples and not a guarantee. Your results depend on your own effort, experience and circumstances.
8. Liability
8.1 We are liable without limitation for damage caused intentionally or through gross negligence, and for injury to life, body or health.
8.2 In cases of slight negligence, we are only liable for the breach of essential contractual obligations, limited to the foreseeable damage typical for the contract.
8.3 We are not liable for the continuous availability of the members area or for third-party services (such as payment providers or hosting).
9. Data Protection
We process your personal data in accordance with applicable data protection laws. Details can be found in our Data Policy.
10. Governing Law and Jurisdiction
10.1 These Terms are governed by the laws of the Federal Republic of Germany. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of their country of residence.
10.2 For business customers, the exclusive place of jurisdiction is Hamburg, Germany.
11. Changes to These Terms
We may update these Terms from time to time. The version valid at the time of your order applies.
12. Severability
If any provision of these Terms is or becomes invalid, the remaining provisions remain unaffected.
